2009 was a year that saw many changes in employment law directly impacting employers and their HR practices. The Supreme Court, Congress and the Commonwealth of Massachusetts have all implemented changes that affect employers. More changes are likely coming in 2010. Given the many developments and the consequences of non-compliance, it is important to keep current on the law and apply best practices in managing employees. Using an interactive format, we will update you on a variety of important topics, including:
• The importance of properly classifying your workers: are you lawfully using independent contractors?
• Utilizing non-compete, non-solicitation and confidentiality agreements: how will proposed legislation affect your right to protect valuable business assets?
• Changes to the Americans with Disabilities Act ("ADA")
• The use of social media in the workplace • The duty to accommodate persons with disabilities
• The Employee Free Choice Act ("EFCA") -- how you can be prepared for changes in rules governing employee union organization
Our Speakers:
David Cogliano, Esq., Davis Malm & D'Agostine, PC David practices in the Employment and Litigation
areas, advising employers on labor and employment issues, policies, and practices, including discipline and discharge, wage and hour compliance, harassment, hiring practices, FMLA, and ADA compliance and restrictive covenants. He regularly litigates employment issues before the EEOC, the MCAD, and in federal and state courts. David has represented both individuals and corporations and has had extensive experience representing multistate employers. He also represents hospitals, physician groups, and individual physicians assisting them to address the unique requirements of the medical profession. David's employment practice also involves preparing and negotiating noncompetition agreements, severance agreements, and executive employment agreements.
Rory Fazendeiro, Esq., Adler Pollock & Sheehan, PC Rory Fazendeiro is a litigation attorney with the
Boston office of Adler Pollock & Sheehan P.C. Rory represents management and employees in a wide range of employment-related matters, including wage and hour law, non-competition and trade secret claims, and employment discrimination. Rory also has experience negotiating and drafting employment contracts and severance agreements, and he frequently counsels clients on issues involving federal and state employment laws, inluding FLSA, NLRA, Title VII and ADA.
Robert M. Shea, Morse Barnes-Brown Pendleton, PC Bob Shea is a shareholder of Morse, Barnes-Brown,
Pendleton, P.C. in Waltham, MA, where he counsels businesses in all areas of employment and labor law. He represents clients in employment litigation before federal and state agencies and courts. Bob graduated from Boston College and received his law degree from George Washington University National Law Center. Before joining Morse, Barnes-Brown & Pendleton, Bob was a partner in the Boston office of Nixon Peabody LLP. He is a past co-chair of the Boston Bar Association's Labor and Employment Law Section. Bob is also a member of SBANE's Board of Directors and serves on SBANE's Human Resources Committee.
